Terms and Conditions

These terms govern your access to and use of the HIPHOP.WORLD platform, including HIPHOP.WORLD, HIPHOP.ID, and all associated domains.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Definitions

"Hip Hop Cash" or "Cash" refers to the Platform's digital currency with a fixed supply of 1,000,000,000 units, used to create, trade, and interact with assets within the HIPHOP.WORLD.

"Hip Hop Card" or "Card" refers to a digital asset created by locking 100 Hip Hop Cash, which may include media content (audio, photo, video) or utility functions such as marketing links.

"Hip Hop Community" or "Community" refers to a non-fungible token (NFT) representing a personal game board consisting of 100 Hip Hop Places, created by locking 10,000 Hip Hop Cash.

"Hip Hop Place" or "Place" refers to one of 1,000,000 unique digital locations within the Platform, each a type of Card that hosts other Cards.

"Hip Hop Land" or "Land" refers to one of 100 territories within the HIPHOP.WORLD, each containing 100 Communities.

"Stacking" refers to the act of posting a Card to a Place, where the Card occupies a permanent position in the Place's stack ordered by time of placement.

"Holder" refers to a wallet address that possesses a copy of a given Card.

"Network" refers to a group of Communities organized under the governance of a lead Community for the purpose of pooling voting power.

2. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater, to use the Platform. By using the Platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

3. Account and Wallet

3.1 Account Creation

You may access the Platform by connecting a compatible cryptocurrency wallet (such as MetaMask, Phantom, or Xverse) or by authenticating through supported social login providers (including Google, Discord, Spotify, SoundCloud, LinkedIn, Battle.net, Twitch, or email). You are responsible for maintaining the security of your wallet credentials, private keys, and login information.

3.2 Account Responsibility

You are solely responsible for all activity that occurs under your account or wallet address. We are not responsible for any unauthorized access to your account resulting from your failure to secure your credentials. You agree to notify us immediately of any unauthorized use.

HIPHOP.ID

Your HIPHOP.ID (managed at hiphop.id) serves as your identification layer on the Platform, encompassing your profile, wallet connections, and authentication credentials. You are responsible for the accuracy of information associated with your HIPHOP.ID.

4. Digital Assets

4.1 Hip Hop Cash

Hip Hop Cash is a digital utility token used exclusively within the Platform. It is not legal tender, is not backed by any government, and should not be considered an investment or security. The total supply is fixed at 1,000,000,000 units. We make no representations regarding the future value, if any, of Hip Hop Cash.

4.2 Hip Hop Cards

Cards are created by locking 100 Hip Hop Cash and assigning a purpose at the time of minting. The purpose of a Card is immutable once created. Cards may carry media content (audio, photo, video), links (marketing cards), or utility functions. Not all Cards contain media. Cards carry their locked Cash value when traded.

4.3 Hip Hop Communities

Communities are NFTs created by locking 10,000 Hip Hop Cash, which assembles 100 Place Cards forming a personal game board. Community creation requires adjacency to an existing active Community within the same Land. Community owners have control over naming, theming, Place upgrades, fee structures, and governance within their Community.

4.4 Hip Hop Places

Places are specialized Cards that host other Cards. Each Place starts as a Block and may be upgraded by the Community owner to one of four elemental types (Stage, Studio, Shop, or Station), each generating a unique resource subject to the global scarcity model. Additional Place types may be introduced in the future.

4.5 Hip Hop Lands

Lands are territories activated through collective achievement — specifically, the completion of a full row or column of Communities within an adjacent active Land. Land governance is determined by the Community or Network with the highest voting power within that Land. The Land Controller has the right to name and configure the Land.

4.6 No Guarantee of Value

Digital assets on the Platform, including Hip Hop Cash, Cards, Communities, Places, and Lands, are virtual items with no inherent monetary value outside the Platform. We make no promises or guarantees regarding the monetary value, liquidity, or transferability of any digital asset. The value of any digital asset may fluctuate or decrease to zero. You acknowledge and accept these risks.

5. Platform Mechanics

5.1 Card Stacking

When a Card is posted to a Place, it occupies a permanent position in that Place's stack. The first Card placed occupies the bottom position (position 1), which holds the most positional power. Subsequent Cards stack on top with progressively less positional power. Stack positions are permanent and cannot be altered, purchased, or transferred once established.

5.2 Holder Count

Each Card tracks the number of unique wallets that hold it. Holder count is an independent metric from stack position and contributes to the Card's value and its host Community's aggregate power. Holder count may fluctuate as wallets acquire or relinquish Cards.

5.3 Voting Power and Governance

Each Community begins with a base voting power of 10,000 (equal to its creation cost). Additional voting power is earned through card placement, holder engagement, resource generation, and governance participation. The Community or Network with the highest voting power within a Land becomes the Land Controller. Governance decisions are managed through hiphop.vote.

5.4 Networks

Players who own multiple Communities or form Teams may organize their Communities into a Network under a lead Community. Networks pool the voting power of their member Communities. Network formation and management is conducted through hiphop.network.

5.5 Progressive Expansion

The HIPHOP.WORLD expands through player activity. New Communities become available for purchase only when adjacent to an existing active Community. New Lands become available only when a full row or column of Communities is completed within an adjacent Land. We do not guarantee any particular rate of expansion.

5.6 Resource Scarcity

Upgraded Places generate resources (Influence, Creativity, Commerce, Reach, and future additional resources). The value of each resource is inversely proportional to the number of that Place type existing worldwide. Resource distribution is subject to change as the global composition of Place types evolves.

6. User Content

6.1 Content Ownership

You retain ownership of any original content (including music, audio, images, video, and text) that you upload, submit, or associate with Cards on the Platform. By submitting content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to display, distribute, reproduce, and make available your content solely in connection with operating and promoting the Platform.

6.2 Content Representations

By submitting content, you represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use and authorize the Platform to use such content, and that your content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

6.3 Prohibited Content

You agree not to submit content that is illegal, defamatory, obscene, harassing, threatening, or hateful; infringes on the intellectual property rights of others; contains malware, viruses, or harmful code; constitutes spam or unsolicited advertising (beyond the use of Marketing Cards); promotes violence or discrimination; or violates any applicable law or regulation.

6.4 Content Moderation

We reserve the right, but are not obligated, to review, monitor, or remove any content that violates these Terms or that we deem inappropriate, at our sole discretion and without prior notice.

7. Posting Fees and Transactions

7.1 Posting Cards

Members pay a fee to the Community when posting Cards to Places. Fee amounts are set by Community owners. By posting a Card, you agree to pay the applicable fee as determined by the Community.

7.2 Trading and Exchange

Cards and other digital assets may be traded between wallets. All trades are final once confirmed on the blockchain. We are not responsible for errors, losses, or disputes arising from peer-to-peer trades. Currency exchange functionality is provided through hiphop.exchange. Resource trading is conducted through hiphop.trade.

7.3 Community Fund

Each Community maintains a fund (managed at hiphop.fund) that records all Cash transactions including posting fees, trading revenue, and upgrades. Fund management is the responsibility of the Community owner.

7.4 Blockchain Transactions

Certain transactions on the Platform are recorded on a blockchain. You acknowledge that blockchain transactions are irreversible, may be subject to network fees (gas fees), and are processed by decentralized networks outside our control. We are not responsible for delays, failures, or losses caused by blockchain network issues.

8. Social Features

8.1 Connections

The Platform supports social connections including one-way follows and two-way friend relationships (managed at hiphop.social). You control your own connections and may follow, unfriend, or block other users at any time.

8.2 Teams

Users who own Communities may form Teams with other Community owners. Teams may serve as the basis for Network formation. Team membership is voluntary and may be dissolved by any member.

8.3 Communication

Real-time communication features (at hiphop.chat) are provided as a bridge to community channels including Discord. You agree to conduct all communications in accordance with these Terms and to refrain from harassment, spam, or abusive behavior.

9. Marketing Cards and Directory

9.1 Marketing Cards

Marketing Cards allow users to associate an external website link with a Card. Marketing Cards are listed in the Hip Hop Directory (hiphop.directory) and ranked by their Hip Hop Cash value. Higher Cash value results in higher directory placement.

9.2 External Links

We are not responsible for the content, accuracy, availability, or practices of any external websites linked through Marketing Cards. The inclusion of a link does not imply endorsement.

9.3 Directory

The Hip Hop Directory aggregates content across the Platform at World, Land, Community, and Place levels. We do not guarantee the accuracy, completeness, or timeliness of directory listings.

10. Prohibited Conduct

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any applicable law
  • Manipulate or attempt to manipulate Platform mechanics, smart contracts, or voting systems
  • Use bots, scripts, or automated means to interact with the Platform without our prior written consent
  • Attempt to gain unauthorized access to other users' accounts, wallets, or assets
  • Engage in market manipulation, wash trading, or fraudulent transactions
  • Impersonate any person or entity
  • Interfere with or disrupt the Platform's infrastructure
  • Circumvent any security measures or access controls
  • Use the Platform to launder money or finance illegal activities

11. Intellectual Property

11.1 Platform IP

The Platform, including its design, code, branding, logo, the "HIPHOP.WORLD" name, color system, and all associated visual and functional elements, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Platform without our prior written consent.

11.2 User License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes (except as expressly permitted through Platform mechanics such as trading and posting).

12. Disclaimers

12.1 "As Is" Provision

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

12.2 No Financial Advice

Nothing on the Platform constitutes financial, investment, legal, or tax advice. You are solely responsible for evaluating the risks associated with acquiring, holding, trading, or disposing of any digital asset. You should consult your own legal, financial, and tax advisors before engaging in any transactions.

12.3 Blockchain Risks

You acknowledge the inherent risks of blockchain technology, including but not limited to: smart contract vulnerabilities, network congestion, regulatory changes, wallet security risks, and the irreversibility of transactions. We are not liable for losses resulting from these risks.

12.4 Platform Availability

We do not guarantee uninterrupted or error-free access to the Platform. We may modify, suspend, or discontinue any aspect of the Platform at any time without prior notice.

13. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or digital assets, arising out of or related to your use of or inability to use the Platform, regardless of the cause of action or theory of liability, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or related to these Terms or the Platform shall not exceed the amount of Hip Hop Cash you have spent on the Platform in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless HIPHOP.WORLD, its founders, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Platform; your violation of these Terms; your violation of any applicable law or regulation; your content; or your infringement of any third-party rights.

15. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform with an updated "Last Updated" date. Your continued use of the Platform after any modification constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitations of liability) shall survive.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HIPHOP.WORLD is incorporated, without regard to conflict of law principles. Any dispute arising from or related to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration body, unless otherwise required by applicable law.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HIPHOP.WORLD regarding your use of the Platform and supersede all prior agreements and understandings.
